RM Motors Terms of Use.
Limited liability company "RM MOTORS", 41503061277, Daugavpils, Niedru iela 4, LV-5418, hereinafter - the online shop - provides the content available on the website and provides goods/services in accordance with the Terms of Use set out below.
1. General rules
If the consumer purchases goods/services through the website, such mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia regulating distance contracts, including but not limited to the “Consumer Rights Protection Law” of the Republic of Latvia, the Cabinet of Ministers Regulations “Regulations on Distance Contract”, etc.
2. Making purchases
The prices and specifications of the products sold in the online shop are listed next to the products.
To place an order, add the desired products to your shopping basket. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order including delivery is then displayed on the screen. Checkout to complete your order.
3. Payment terms
The currency for transactions on the site is euros. Purchases can be paid for using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
- Latvian online bank payments: Swedbank, SEB, Citadele, and Luminor
- Estonian online bank payments: Swedbank, SEB, Luminor
- Lithuanian online bank payments: Swedbank, SEB, and Luminor
- Finnish online bank payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki
- Visa/Mastercard card payments
Please note: When using the online bank payment method, confirm the order and click on the “Return to Merchant” button.
Personal data required for processing payments is transmitted to the licensed payment institution Maksekeskus AS.
The contract becomes effective upon successful payment to the online store’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after the notification.
4. Delivery terms
The goods are delivered to the following countries: Latvia, Lithuania, Estonia, Poland, Germany, Finland, Norway, France, Italy, Netherlands, Czech Republic, Austria, Finland, Spain, Sweden. Omniva SIA, DPD Latvia, SIA, and you can pick up your goods in store. All duties and taxes payable to collect the parcel at the delivery destination are to be borne by the Buyer. The shipping costs are displayed before the order is confirmed. Purchased goods are delivered to the address specified by the Buyer within 3-14 working days. In exceptional circumstances, we have the right to dispatch goods up to 45 calendar days, after informing the customer.
5. Right of Withdrawal
The buyer has the right to withdraw from the purchase within 14 calendar days from the moment of receiving the product. (Depending on the product, the buyer may not have mandatory withdrawal rights; in this case, the reason must be clearly stated and explained). Withdrawal rights do not apply if the buyer is a legal entity.
To exercise the 14-day withdrawal rights, the product may only be used for its intended purposes. The consumer is responsible for maintaining the product’s quality and safety during the withdrawal period. If the products are used improperly or damaged, if the product is handled carelessly during use or if the instructions are not followed, if the original packaging of the product is lost or significantly damaged, the online store has the right to reduce the refundable amount according to the reduction in the product’s value.
To exercise the right of withdrawal, you must submit a withdrawal form, which can be found here: Link, and send it to the email address support@rmmotors.lv within 14 days of receiving the product. It is good practice to provide the customer with free return shipping. This increases trust in the online store, which helps improve sales volumes.
The following sentence is intended for online stores that cannot offer free returns. The buyer bears the cost of returning the product, except in cases where the reason for the return is that the product does not match the order (e.g., incorrect or damaged product).
The buyer must return the product to the seller without undue delay and no later than 14 days after sending the withdrawal form to the online store. After receiving the returned products, the online store will promptly, but no later than 14 days, refund all payments received from the buyer based on the Distance Contract.
The seller has the right to withhold the payment until they receive the product from the buyer or proof of the product’s return. If the buyer has chosen a shipping method other than the cheapest one offered by the online store, the online store is not obliged to compensate for the additional shipping costs.
The online store is not responsible for delays in fulfilling obligations or for non-fulfillment or other types of non-performance arising from circumstances and obstacles beyond the reasonable control of the online store.
The online store reserves the right to refuse to sell products and request the return of products from the buyer if the price indicated on the online store is significantly lower than the market price due to an error.
6. Consumer rights for goods not in conformity with the contract
The online store is responsible for any non-conformity of the goods sold to the buyer or defects that occur within 6 months of the delivery date to the customer, or were present at the time of delivery, if such an assumption is not contrary to the nature or defect of the goods. The buyer must inform the seller of the non-conformity of the goods immediately, within 2 months of discovering it, i.e., by filing a complaint. The buyer can file a complaint by contacting the online store via email at support@rmmotors.lv.
The online store is not responsible for defects that occur after the delivery of the goods to the buyer. If the purchased goods have defects for which the seller is responsible, the buyer has the right to request free repair of the defects or exchange the goods for new ones.
If the goods cannot be repaired or replaced, the seller will refund all payments made under the Distance Contract. The seller will provide a written response to the consumer’s complaint within 15 days.
7. Processing of the Buyer's personal data
The online store processes only the personal data that the buyer has entered when placing an order, such as name, surname, email, etc.
The online store shares personal data with the transportation service provider(s) to ensure the delivery of goods.
If you have expressly consented to receive our marketing communications, including updates, we may occasionally contact you by sending information about our services and the latest offers. For this purpose, we may process your email address that you provided when signing up for marketing communication. The buyer has the option to opt out of marketing communications by informing us via email at support@rmmotors.lv.
8. Dispute resolution
In matters not covered by these terms and conditions, the Buyer and Seller agree to comply with the applicable laws of the Republic of Latvia.
The parties will resolve any disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiation or correspondence, the parties will resolve the dispute in the courts of the Republic of Latvia, in accordance with Latvian legislation. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Center or to the courts of the Republic of Latvia.
The Buyer also has the right to refer the dispute to European Union dispute resolution bodies.
